Farm Share - Herd/Flock Share - Membership
We are your Personal Farmers. We are responsible for the purchase, breeding, brooding and growing of the livestock, maintaining pasture, providing the daily hauling of feed and water to the day range shelters, cleaning of ranges and coops, general farm maintenance and improvements, collecting and packaging eggs, harvesting livestock, and provide protection from day and midnight predators etc. Everything it takes to put a natural, organic, fresh, nutritious, flavor packed meal on your table!
Poultry C.S.A. Share Members: by purchasing ahead and in 3 month installments, provide the capital necessary to purchase the day old chicks, brood, feed, clean, manage and provide all necessary supplies. In exchange, members receive first attention and choice of harvested poultry and eggs.
Rainbow Ranch Farms farm shares program provides our members with delicious, natural locally-raised poultry, meat, eggs and more. As members you help to preserve self sustainable farming practices and the preservation of old fashioned American farming traditions. Your membership helps to protect endangered Heritage Breed livestock, including Chickens, Turkeys, Goats, cattle and Pigs, heirloom seeds and locally grown foods without the use of pesticides, G.M.O., herbicides, or hormones. HERITAGE TURKEYS: Please be sure to adopt your Free Range, Grass Fed, 100% natural Thanksgiving Turkey as soon as possible. We do not grow more than we need.
POULTRY: When your fresh poultry and/or fresh turkey arrive, they will not be frozen; in fact they will be cool to the touch and pliable. Remember to prepare, refrigerate or freeze, immediately upon arrival.
EGGS:Your eggs are unwashed and maybe fertile! They go from the coop into the cartons, as they are collected. They have never been washed or refrigerated. The protective bloom is still intact when you get your eggs. Keep them in a cool, dry, dark area until ready to use, you may refrigerate if you choose. Wash your eggs before using.
FARM AND HERD SHARE PROGRAM AGREEMENT: We are a private, member only farm and we are not open to the general public. Only farm share holders may purchase from our farm. PLEASE PRINT THIS, initial every number after reading, sign and date, then send the farm an original and be sure to keep a copy for your records.

BEGINING OF FARM SHARE AGREEMENT
FARM FLOCK AND HERD SHARE AGREEMENT: PLEASE PRINT THIS, sign and return to the farm and be sure to keep a copy for your records. You can also print, sign and return to the farm via postal service or via email. We reserve the rights to decline membership. Membership renewals are every January.
PRIVATE CONSUMER COOPERATIVE MEMBERSHIP AGREEMENT
I, ____________________________, (hereinafter, Member) for the sum of fifty dollars (50.00), purchase membership in Private Consumer Cooperative (hereinafter, the Association). This membership is renewable annually in January for the same fee. In purchasing this membership, Member acquires an undivided interest in the herd and poultry flock lease agreement entered into between the Association, Member and Rainbow Ranch Farms (hereinafter, the Farm). Through the interest in the lease agreement, Member may obtain raw dairy, meat and poultry products from the Farm. Member is also entitled to purchase other sustainably grown farm products from the Farm when they are available.
By signing below, Member has read, understands and agrees to the following:
1. All raw dairy products are labeled FOR PET USE ONLY: According to the State Department of Agriculture, Food and Drug Administration and the United States Department of Agriculture it must be labeled FOR PET USE ONLY or NOT FOR HUMAN CONSUMPTION. According to the F.D.A raw dairy can contain harmful bacteria. NON-homogenized and UN-pasteurized RAW dairy products can be hazardous to your health, and is not legal in many states throughout the United States of America.
1a. Personal Use. Any dairy, eggs, meat and poultry products received will be for personal use only and shall not be sold and shall not be distributed to anyone outside the Members family and/or guests.
2. Education. Member understands and acknowledges that raw dairy, eggs, meat and poultry may contain harmful pathogens and that its consumption is not recommended by the Centers for Disease Control (CDC), the Food and Drug Administration (FDA), or the State Department of Agriculture and Public Health (SDAPH). Member agrees to educate Member’s family about the risks associated with the consumption of raw dairy and with the improper storage of raw dairy, eggs, meat and poultry.
3. Waiver of Claims Against the Association. Member acknowledges that there are or may be risks of harm encountered in visiting or entering the Farm or any other premises where the leased herd/flock is located including but not limited to visiting and/or interacting with the herd/flock and/or other animals that may be found in the vicinity of the herd/flock. Member hereby knowingly and voluntarily assumes the risk of any and all such harm and also hereby waives any and all right to make, file, or pursue any claims, demands, suits, actions, causes of action, damages, etc. against the Association and/or any of its members, agents, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. that arise out of or in any way relate to any injury, illness, death, loss or damage caused, in whole or in part, by (a) the handling or consumption of raw dairy, eggs, meat and/or poultry products and/or any other food obtained from the Association or the Farm, (b) visiting or entering the Farm or any premises where the leased herd/flock is located, (c) the care and/or boarding of the leased herd/flock.
4. Waiver of Claims Against the Farm. In addition, Member waives any and all right to make, file, or pursue any claims, demands, suits, actions, causes of action, damages, etc. against the Farm and/or any of its owners, agents, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. that arise out of or in any way relate to any injury, illness, death, loss or damage caused, in whole or in part, by (a) the handling or consumption of raw dairy, eggs, meats and/or poultry products and/or any other food obtained from the Association or the Farm, (b) visiting or entering the Farm or any premises where the leased herd/flock is located, (c) the care and/or boarding of the leased herd/flock.
5. Indemnity - Association. Member shall indemnify and defend the Association and its members and shall hold harmless the Association and its members, agents, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. against any and all demands, claims, suits, actions, causes of action, etc. for any injury, illness, death, loss or damage that arises out of or relate in any way to (a) any handling, processing, consumption, or use of any meats, eggs, poultry or dairy product made from the milk produced by the leased herd/flock after it has been retrieved or otherwise obtained by the Member, (b) the visit by any person that Member brings to or causes to visit the Farm or any premises where the leased herd/flock is located.
6. Indemnity - Farm. Member shall indemnify and defend the Farm and its owners and shall hold harmless the Farm and its owners, agents, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. against any and all demands, claims, suits, actions, causes of action, etc. for any injury, illness, death, loss or damage that arises out of or relate in any way to (a) any handling, processing, consumption, or use of any poultry, eggs, meat, milk or dairy product made from the milk produced by the leased herd/flock after it has been retrieved or otherwise obtained by the Member, (b) the visit by any person that Member brings to or causes to visit the Farm or any premises where the leased herd/flock is located. .
7. Entrapment. Member attests and affirms that he/she is not an agent for a federal, state, or local government agency trying to entrap or investigate the Farm and its owners.
8. Severability. If, for any reason, any provision or provisions of this agreement are determined to be invalid and contrary to any existing or future law, such invalidity shall not impair the operation or affect those portions of this agreement which are valid.
9. Captions. The captions of sections and subsections contained in this agreement are for convenience only and shall not control or affect the meaning or construction of any of the provisions of this agreement.
